Introduction

This chapter is concerned with some aspects of the regulation of age discrimination. Of interest really is the way that age discrimination is treated in comparison to other possible grounds of discrimination such as disability, race or sex. One of the arguments put forward here is that age is treated differently than other grounds because there are still an important amount of age-related practices that are considered legitimate. This chapter first considers the motivation for age discrimination legislation; then looks at the debate taken in the European Court of Justice as to whether equality in relation to age amounts to a fundamental principle of Community law; we then examine the legislation enacted in the EU and ...
